NW Home Maintenance and Repair - Terms of Service

This Agreement ("Agreement") is effective as of the date the invoice was sent by NW Home Maintenance and Repair, hereinafter referred to as the "Service Provider."

Scope of Work:

1.1 The Service Provider agrees to provide carpentry, handyman, and maintenance services as specified in the agreed-upon project proposal or work order.

Payment:

2.1 Payment for services shall be as outlined in the project proposal or work order.

2.2 Fifty percent (50%) or the amount of materials must be paid upfront before the commencement of the project. The remaining amount is due and payable within 10 days of the completion of the project unless otherwise agreed upon in writing.

2.3 Late payments may be subject to interest charges of 10% per month.

Project Changes:

3.1 Any changes to the scope of work must be agreed upon in writing and may result in adjustments to the project timeline and cost.

3.2 The Service Provider reserves the right to revise the project cost and timeline in the event of unforeseen circumstances or changes requested by the client.

Materials and Equipment:

4.1 The client may be responsible for providing necessary materials unless otherwise specified in the project proposal.

4.2 The Service Provider is responsible for providing and maintaining all required tools and equipment to complete the project.

Project Timeline:

5.1 The project timeline will be outlined in the project proposal, and both parties agree to work together to adhere to the agreed-upon schedule.

5.2 Delays caused by unforeseen circumstances such as weather conditions or material shortages are not the responsibility of the Service Provider.

Insurance:

6.1 The Service Provider agrees to maintain appropriate insurance coverage for liability and workers' compensation.

6.2 The client is responsible for securing insurance coverage for any damage to their property during the course of the project.

Warranty:

7.1 The Service Provider warrants that all work will be completed in a workmanlike manner and in accordance with industry standards.

7.2 Any defects or issues discovered within 10 days of project completion will be promptly addressed and corrected by the Service Provider at no additional cost to the client.

Termination:

8.1 In the event of termination, the client agrees to compensate the Service Provider for services rendered up to the termination date.

Confidentiality:

9.1 Both parties agree to keep confidential any proprietary or sensitive information obtained during the course of the project.

Governing Law:

10.1 This agreement shall be governed by and construed in accordance with the laws of Tasmania, Australia.

Dispute Resolution:

11.1 Any disputes arising out of or in connection with this agreement shall be resolved through negotiation and, if necessary, arbitration in accordance with the rules agreed upon by both parties.

Costs of Recovery:

12.1 The debtor(s) shall pay for all costs actually incurred by NW Home Maintenance and Repair in the recovery of any monies owed under this Agreement.

12.2 You agree to be liable for and indemnify these costs, including recovery agent costs, repossession costs, location search costs, process server costs, solicitor costs on a solicitor/client basis, debt collection commission, and legal fees on an indemnity basis.

Entire Agreement:

13.1 This agreement constitutes the entire understanding between the parties and supersedes all prior agreements, oral or written, relating to the subject matter hereof.

14.1 By accepting the job, you agree to the terms and conditions outlined above.
